A common misconception among property developers is that Land Remediation Relief (LRR) applies exclusively to chemical or biological soil contamination. In reality, Part 14 of the Corporation Tax Act 2009 contains explicit provisions for derelict land, allowing developers to claim tax relief on removing buried concrete slabs, old basements, and structural obstructions.

The Derelict Land Gateway Test

To claim LRR on buried structural obstructions, the site must meet the statutory definition of derelict land:

  • Statutory Requirement: The land must have been in a derelict state—unproductive and incapable of beneficial use without removing subsurface structures.
  • Time Requirement: Under current statutory rules, the site must generally have remained derelict since at least 1 April 1998 (or since its original industrial usage ceased).
  • Land Unproductive / Incapable of Use ➔ Subsurface Structural Obstructions Impede Development ➔ LRR QUALIFYING

Evidencing Site History for HMRC

Claiming LRR on derelict structures requires clear documentation of historical site use:

 

Historical Ordnance Survey Mapping: Proving the site was clear of active commercial buildings over the required statutory period.

Ground Investigation Reports: Site logs detailing buried obstructions that prevented standard construction piling or trenching.

Contractor Cost Breakdown: Isolating ground-clearing itemised plant hours, crusher costs, and excavation invoices from general groundworks.

Qualifying Subsurface Demolition Costs

Not all demolition work qualifies for Land Remediation Relief. The key distinction lies between above-ground building demolition (which generally does not qualify) and subsurface groundwork clearance (which does qualify).
